Republcians' newest mistake

Republicans’ newest mistake

Romney has been ordained by the Republican hierarchy as the candidate to beat. This transition occurred during the last two weeks and unseen forces are pushing the other contenders aside. Fox news is carefully crafting pieces to lessen the worth of the competition in an attempt to polish Romney’s visage. Gingrich, a former Fox political consultant, now has an image problem that did not exist a fortnight ago. Ron Paul has been dehumanized and marginalized as the candidate from the theater of the bizarre. Rick Perry has been played as an awkward simpleton who has yet to learn how to tie his shoes. The rest of the pretenders to the throne have not made it half way. Romney’s tangential experience with politics as governor of the Bay State resulted in his tragic health care legislation code named Romneycare. It is strangely similar to the Obama product that is now infesting a state near you. His stance on other issues has given many republicans a reason to pause. Could we be exchanging one problem for another when November 2012 arrives? Romney is presently maneuvering through the political landscape greased with tens of millions from his own pocket. Added to the large sums now pouring in because he had has been deified as the candidate to look towards, the remaining crew might as well give up. Lawyers appear to have problems managing intricate systems. Perhaps this is the reason Romney left when his health disaster was taking shape. Pessimism is working its way into some quarters of the conservative movement because Romney is not that picture perfect candidate they had in mind. If there is someone in the darkness better than the current crowd of presidential wannabes, now is the time to materialize.  Those who profess an interest in the throne from the sidelines would rather critique the present crew than jump in. There is a real possibility that those who were fooled before may make the same mistake again. Study your candidate thoroughly before you throw the lever because this could be the last time you are permitted to vote. Mark Davis MD, author of Demons of Democracy, platomd@gmail.com

Fox: fair and balanced think again

Fox: fair and balance think again

Polished, primed and primped the assemblage of commentators at Fox News Network have been insinuating for years their presentations are fair and balanced, think again. Recent changes in polling evaluations of the presidential wannabes have significantly changed Fox’s coverage of the candidates. Marching orders from the top have these media voices propagandizing that Mitt Romney is the candidate of choice, who stands higher than the others in the lineup. Coverage of Newt Gingrich now slants towards the negative as Romney attracts more support around the country. The problem is Romney may be the worse candidate on the platform. Looking presidential, whatever that means, is insufficient substance to embody someone with the powers of the Executive branch. Fox is asking its viewers to believe that information they presented before on the cadre of candidates does not matter. Somehow, through the magic of Fox media, Romney has been ordained as the person to go to. Romney’s baggage is extensive and replete with inconsistencies. Notice that Fox is playing down the vices of Romney care and pumping up an image of this former governor that he will dissect and destroy Obamacare, not true. You may have missed the first debates when Romney noted in the event that he acquired the presidency he would waiver out all fifty states. The former lawyer in him must have been channeling Obama because he had to know that was not possible. Congress must defund it and ultimately decimate this monstrous health initiative to rid it from our lives. Romney’s Freudian slip concerning global warming leads us to believe he is part of the problem in that area. Prior to the implementation of Romney care in 2006, the governor of the bay state abandoned his post, so he would not have to face the repercussions that have now presented themselves. More recently Romney’s attack ads on the other candidates have received little notice by Fox’s ordained choice for 2012.  With a questionable business background, a legal mentality that could be a detriment to his cognition and his stance on current issues, Romney’s glow is weak at best. Fox is trying to lead its flock to support a candidate who has many similarities to the reigning royalty. For prior reasons and more I suggest strongly that you obtain your news from many sources, Fox has lost its balance. Mark Davis MD, president of Healthnets Review Services. platomd@gmail.com

Maryland's entrapment of physicians

Maryland’s entrapment of physicians

Twenty four thousand physicians have been granted licenses to practice the medical arts in Maryland. This privilege came with one caveat, their licenses would be supervised by the Maryland Board of Physicians. Of the 21 political appointees on the Board forty percent are not physicians, which questions the extent of the expertise embedded in its membership. Worse, the Boards functions are not managed by physicians. Instead its administrative staff, which is heavily weighted with attorney input, runs the operations on a day to day basis. The Board’s quality assurance section is administered by lawyers, not physicians. Imagine the Maryland State Board of Law Examiners being fronted by physicians, the state would see an major reduction in malpractice suits. Maryland Board of Physicians must comply with Maryland legislative mandates which are in place to protect the public from errant physicians and to provide doctors a level of due process when their practices come into question. To carry out these functions rules and regulations must be promulgated by the Board to administer its authority, unfortunately they haven’t been written. Because of this specific failure, licensees are at a loss to know when they have transgressed certain boundaries this rogue Board may consider outside the scope of standard practice. It is the Board itself that has been found to be functioning outside Maryland law and mandate. In a scathing report issued recently by the Maryland Legislature against the Board of Physicians, the very basis of this Board’s existence is questioned. Dozens of citations noting the Board did not follow Maryland law and mandate when performing its function is part of this extensive report. More to the point, they were illicitly screwing physicians when they themselves were acting outside the bounds established for them. To make matters worse the Maryland Attorney General’s Office is guilty of violating the very laws they are empowered to uphold. This arm of Maryland government has knowingly lied to Circuit Court and Appellate judges that the Board of Physicians was following appropriate procedures and Maryland law as it hammered physicians for the most trivial of occurrences. The quiescent Maryland Medical Society has not weighed in on this report. They spend too much time in self-preservation mode to keep the cash coming in from its few members to take an interest in such minor matters. Perhaps physicians who have been affected by this rogue unit of Maryland government should file a class action suit against Maryland Department of Health and Mental Hygiene, the Board, the Health Secretary and the Attorney General’s Office for perpetuating the illicit activities of an administrative authority that should have been reined in long ago. A Presidency in Obsolescence

A Presidency in obsolescence

Long before Obama walked the corridors of the White House, his mind was being molded to the president he would become. Embedded in his subconscious mind are all the deformities he believes casts America in the shadows of other nations.  When he ascended to the Executive branch his apologetic behavior was indicative of those beliefs and the rectification to come. American presidents usually put their country in the best light possible, Obama’s approach was too damn the very nation that elevated him to his present office. Worse, his deep hatred for this country led him to find unique paths to decimate its institutions and traditions. Under his tutelage cockroaches and minnows have more rights than farmers whose lands they inhabit. Any excuse to impede energy production was primary in his mind, jobs lost took a backseat. Iran no doubt is developing a nuclear weapon. In the event their research was for any other purpose those technologies are already available. Obama’s penchant of noninterference in the affairs of rogue nations such as Iran, is leading this country to the edge of a dangerous precipice. Congress fails to see the bigger picture, America is a few steps from a nuclear exchange and they argue over trivial issues. Those who run the State Department must have blinders on. Obama is looking the other way as Iran and a few other nations are bringing to fruition bombs that can kill millions. Are Obama’s hatreds so deep that he would allow the deaths of millions to display a politically correct posture to the Middle East? Or are his motivations something else. Perhaps his ineptitudes are so deep that he cannot see the internal and external strife that is brewing right in front of him. Presidents are supposed to lead and guide their flocks to better times, this inhabitant of the White House has improved his situation at the expense of hundreds of millions. The minds that occupy the stratosphere of thought behind the ivy fronts should conclude that the present format of the American presidency has reached a state of obsolescence. America should consider the obvious fact that imbuing one person with all the powers given to Obama does not work for 320 million people. Decades to come when America moves back on a sound footing, the times of Obama will be remembered as a minor defect in a long history of tragedies this country had to endure. Obama's Dystopian views

Obama’s dystopian views

Obama’s quixotic vision for America is not held by the majority. Centralized control of welfare to health care cannot be realized under the umbrella Obama wants to put in force. Legislations now in place that allows the Federal elites to invade your checkbook, home, workplace and any place USA can only lead to detrimental effects that move us towards totalitarianism. With three years nearly completed, the president has constrained much of the financial industry, placed new inhibitions on auto manufacturers, torn down health care barriers and erected larger ones, diminished the military, destroyed NASA, taken foreign policies to new lows and sundry other defects he has introduced to make America long for GWB or even Clinton. Four years can be an eternity when the unscrupulous  inflict  authorities, mandates, edicts and instabilities upon a population that has prospered by its empowered freedoms. Constitutional dementia has been the cornerstone of Obama think, projected by teleprompter rhetoric that mesmerizes some, but the rest see through his sophistic façade.  Energy programs that are not sustainable, cost billions to produce a few kilowatts of energy, display Obama’s lack of sophistication in the economics of science. Worse, his stance on energy production within the confines of the fifty states curry favors with environmental extremists who would like to see us back in caves. Much to the chagrin of those who hide Obama’s past student records, his present actions are indicative of a man whose fund of knowledge is slim at best. Moral decline has been accelerated during this leader’s toothless tenure. Strengthening family values is not for someone with an obsession for homosexual equality, whatever that means to him. Will America end up like the cities of Sodom and Gomorrah, destroyed by fire from the heavens? This view may not be so outlandish when one considers our weak foreign policy that allows extremists to develop nuclear weapons.  On this Holiday weekend the President flees to his personal utopia leaving us behind to fend for the few crumbs his administration hasn’t taken. Obama’s dystopian views echo similar political thought that has reverberated through the centuries.  This weekend think about what you have, it may not be there much longer. Washington's Godless Christmas

Washington’s Godless Christmas

Amongst the concrete structures that houses Washington’s elite this holiday season there are few representations marking the religious bent of this time period. Has Washington gone atheist? Religious neutrality has been called for by the White House in speech, physical symbolism and the written word. God is out along with Judeo-Christian morality and tradition. Obama think, deconstructs the best of America, replacing it with politically correct pseudo religious doctrine that debunks most of our beliefs. It does not take much imagination to realize our reigning monarch’s façade of Sunday visits to God’s domain is nothing more than a superficial display of faith for the masses. From marriage to the application of health care an evolution in thought has come with the Obama presidency. Viewing his doctrinal leanings certain precepts apply. There is no more terrorism. Instead these are manmade events. Life is only valuable when you pay into the system. All others go to the back of the line in the event you need health care. Middle Eastern religions have now been given a new spin with incentive from the Obama administration. They have been put on the same platform as those revered by 95% of the population. Working Americans should bleed economically so the decadent, indolent and lazy can sit idle. America’s masses have been disoriented by rhetoric that divides, misleads and removes the most valuable from our lives. Religion, family and our collective moral compass is under assault by those who have vacated these gifts long ago. Christmas is a time to remember all the things that make us who we are, but other forces are at work to negate these memories. Reflect on America’s Christmas trees in Washington over the last several decades, all have commemorated the season with enthusiastic exposes. This year the tree is diminutive, misshapen and decorated with third rate ornamentation. Could we extrapolate from this presentation that Washington is trying to neutralize the true intent of this Holiday? For the majority of us that guide our lives with some semblance of faith there is a way to toss these heathens from office, vote right this time, God is on our side. Republicans lose in 2012

Republicans lose in 2012

Republican hierarchy is pushing the wrong candidate against Obama that guarantees a democrat win in 2012. There exists a plethora of suspicions about Romney that the conservative media cannot quell with spin or other devices at their disposal. When Newt Gingrich surged passed the other candidates, the Republican machinery went into full force to denigrate him from every angle possible. From nuanced media rip to outright lies they have spared no expense to bring him down. Resilient, flexible and intellectually sound Speaker Gingrich has much more to offer the American public than a former governor who abandoned ship when he was most needed. Romney moved out of the house when his massive health legislation came on board. His representations of Romneycare are factually inaccurate when he discusses its virtues and vices. His mind is hampered by a legal education that diminishes his perspective on the current conditions in the country. Newt Gingrich perseveres through the quagmire placed before him because he is a seasoned politician that sees the bigger picture. His breadth and depth of knowledge of history and politics markedly transcends his opponents when he is put to the task of debating them. Behind the scenes manipulations have occurred on a grand scale in the media to push their favored candidate. Rush Limbaugh is now singing the praises of Romney. Fox network has gone out its way to move Gingrich outside the center of attention and move Romney in. A cavalcade of conservative voices is attempting to ordain Romney as the nominee. Many of us in the conservative movement have our reservations about this man, whose personal baggage surmounts that of the former Speaker. For some intangible reason those who hold a legal degree have an inability to understand the intricacies of government functions and how to use them most efficiently. Romney will fall short in any debate with the present Commander-in-chief, Gingrich will unravel the true Obama when they go head to head. Romney is the wrong candidate at the wrong time who will lead the Republican Party to defeat in 2012. Listen to your own conscience not the of the overpaid media hogs who wail in unison when they are given the word. Dreams my father never had

Thirty years ago my father entered a hospital for the last time. His heart and lungs were weak from forty years of nicotine exposure. My dad could never conceive that his physicians would ever hasten his demise with treatment plans that were not in his best interests. Three decades later his worst nightmare has become a reality. Cutting edge and aggressive therapies are being constrained by an overreaching government that has burdened physicians with trepidation not encouragement. Death panels are not necessary, a physician’s fear of malpractice suits and or medical license revocation is sufficient to impede overzealous therapies. Advanced cardiac disease or stage four cancers do not always lend themselves to well categorized therapeutic interventions. Therapies on the edge many times become  tomorrow’s cures. Physicians are being coerced into following a train of thought that reflects a one pattern fits all mentality. Elements of medical care by their very nature cannot be contained by a singular standard or line of reasoning. In the instance when a person is confronted with a life threatening issue many standard treatments do not match the infirmity incurred. Should a physician move beyond the realm of common thinking and take medical care to the edge or utilize government rational to limit application of therapies? Present mindset is to deter those who think outside the proverbial box and go to the limits to save a life. Presented with a life threatening cancers in the 1970s, physicians would follow through on any therapy to find a cure. In 2011 physicians under the same or similar circumstance would tell a patient go enjoy your remaining days. A recent occurrence in my own family exemplifies the course physicians will take when they confront a stage 4 pulmonary cancer. Instead of attempting to arrest the tumors standard palliation was offered. Why go to the edge when a potential sanction a year down the road is a real possibility. Medical care does not come in a can or a box. It cannot be distilled down to a few basic essentials. Diagnostics and therapeutics are complex offerings which become more intricate as a disease moves through its various stages. Physicians need support and guidance not confrontation and sanction when pursing various life saving measures. Tell that to the Maryland Board of Physicians who are reactive not proactive. As a result of administrative negligence, failure to promulgate rules and suppression of physicians’ basic due process rights, Maryland’s physician board will cause many needless deaths. The irony is those who force physicians to follow fabricated standards of care may one day beg a doctor to go to the edge for them. Mark Davis, MD author of Demons of Democracy, platomd@gmail.com

Romney: wrong politician wrong time

Romney: wrong politician wrong time

Rehearsed, polished and visually respectable, Romney is the cookbook politician that is similar to our present reigning monarch. America’s Chief Executive needs to be erudite, insightful and experienced in the ways and mannerisms of a political insider, yet completely open to change when it is required. Romney craftily answers questions with statements that skillfully avoid their intent. Over the course of more than a dozen debates, an evolution has taken place in his cognition, whose nuances have grown into mega changes in his mentation. Obamacare was initially waived away in a Romney presidency, yet the lawyer in him knew that solution was a ruse. Romney’s statements are never impromptu, instead a litany of rehearsed mini speeches emanate from him that attempt to cloister his true stance on the topic presented. Romney moves through his day defending himself including; his prior business record, the large profits he made at the expense of the work force under his command, Romneycare, his global warming stance and sundry other issues important to the voting populous. His campaign has not caught fire with many in the Republican Party because there is a perceived element of distrust about him from his prior private/public record. The Republican hierarchy is doing its best to denigrate the other candidates, in order to make Mitt the top dog. Unfortunately, Mitt’s bark may have taken a bite out of his personal believability. Right wing media is falling in line attempting to cast the other presidential contenders in less than amenable terms. Romney is a mistake that has already been made in the visage of Obama. America needs a consistent experienced person to be president, not someone whose timidity will inhibit him from taking the fight to those who dishonor America with every word they utter. Rush Limbaugh and his conservative comrades are pushing the wrong button this time. When you vote push the right button because the person you help to elect will control the red one. Medical scams Maryland style

Medical scams Maryland style
Maryland Board of Physicians is many things, but honesty and integrity eludes them. A munificent Maryland Legislative administrator released a copy of the recent audit of the Maryland Board of Physicians to my office. Imposed on this administrative authority is a clear set of laws, mandates and regulations to carry out its functions. According to the Legislative audit the Board of Physicians and its staff have a collective case of amnesia, they forgot these laws exist. The Board’s regulatory structure is designed to safeguard Maryland citizens and provide due process to the health practitioners targeted for review. The Maryland Board of Physicians has failed at both of these objectives. Worse, friends of the Board get special treatment when a suspicion is raised about the quality of their work. How many times have you seen a physician from John Hopkins or University of Maryland medical centers castigated by this Board? Hundreds of doctors in Maryland run trauma mills that bill tens of millions of dollars to insurance companies for quasi claims, where are their reviews? Perhaps you have read the promulgated set of rules the Board has generated to carry out its mandates established by the Maryland Legislature, they don’t exist. Maybe you have noticed that politically active physicians get a pass in Maryland when accused of an egregious event. Those of you who still have some analytic abilities may have perceived that the Maryland Board of Physicians hammers politically unpopular physicians, who do not fall in line with the agenda of the week. The politically appointed Maryland Secretary for Health was asleep in his expensive office when this audit was released. Once he woke up the excuse machine was turned on to offset his obvious failure of oversight. Sometimes illegalities cannot be swept under the proverbial rug and that is exactly what has happened. Maryland Attorney General’s Office has been the CHIEF  ENABLER of the illegalities that have infected the Maryland Board of Physicians. Those who need proof should look no further than the Legislative audit. Nearly all the legal work for the Maryland Board of Physicians is performed by the Attorney General’s Office. The two links are obvious.  Physicians who are targeted for review by the Maryland Board are in fact being condemned by a Maryland administrative agency that has worked outside its mandates and the law. Maryland Medical Society has not commented on this legislative audit. Their stance on any issue emanating from the Maryland Board of Physicians is usually dead silence. What about the Courts? Do not hold your breath. Perhaps sense and sensibility will emerges if the Legislature is allowed to play the last note. Mark Davis, M.D. President of Healthnets Review Services, platomd@gmail.com

Maryland Appellate Courts: A question of judicial integrity

Maryland Appellate Courts: A question of judicial integrity

Imagine a state court that is mandated to provide honesty, integrity and judicial balance in their opinions, yet produces outcomes that cannot live up to these three ideals. Maryland has such a judicial forum in the form of the Court of Special Appeals. Cloistered in their sacred halls of judicial wisdom in Annapolis, this Court’s determinations many times are blind to the laws they mandated to apply. Tribunals of three judges deliberate the merits of appeals that reach their benches unfortunately influences external to these cases’ core subject matter shade their opinions. An Opinion that Judges Krauser, Wright and Salmon “REFUSE” to publish and veers away from established Maryland law and mandate arrived on my desk two months ago. Their Opinion reinforces fabrications that the Maryland Board of Physicians levied against the author of these words (Case Number 2587, September Term, 2009 Maryland Board of Physicians v. Mark Davis, M.D). This Opinion is further denigrated by a recent audit by the Maryland Legislature of the Maryland Board of Physicians noting due process rights for physicians have been abbreviated and or completely voided by this administrative entity. Dozens of criticisms embedded in this audit display physicians were used as pawns as they were moved through a process that had one goal, sanction the doctor no matter what the circumstance. When an administrative authority exists that flouts the very laws established to allow it to perform its functions, how can any physician be held responsible for his/her actions and or be sanctioned under these circumstances. Judges Krauser, Wright and Salmon had to know when they wrote their Opinion that Maryland Board of Physicians did not follow the law when prosecuting this author’s civil case. Worse, they completely negated the contents of the appeal before them which established in detail that the Maryland Board of Physicians performed subpar in its peer reviews of physicians and more egregious violated dozens of laws to bring their sting to hundreds of doctors. There is only one conclusion that can be drawn from this Opinion of the Court of Special Appeals, it ceased to be an independent bastion of judicial reason and intellect. Instead this Court will place it rubberstamp imprint on any fabricated trash from the Maryland Board of Physicians. In this specific case, the Court knew that their Opinion skirted state law, yet they were willing to put their necks out to save this failing administrative entity. Judges Krauser, Wright and Salmon are REFUSING to publish their FRAUDULENT Opinion, knowing that every physician, lawyer and the Maryland population as a whole will know their Appellate Courts are CORRUPT. Marylanders have accepted a certain level of corruption from their politicians for years, now they can add the Appellate Courts to this list. Maryland Board of Physicians confrontational approach to governing

Maryland Board of Physicians confrontational approach to governing

Maryland Board of Physicians seems to have touched many lives, unfortunately not in a positive manner. Many physicians have contacted me after a series of articles, written about this administrative entity, appeared in the Baltimore Examiner. A flood of horror stories so profound one could question why anyone would want to pursue a medical education. Maryland Legislature’s release of an audit of the Board of Physicians is an excellent first step in bringing them back into alignment with state law and mandate. Lack of transparency has allowed the Board to work outside the framework established by the state legislature to inflict a massive amount of harm on the physicians they victimize. Determined to improve their number of physician sanctions, as stated by their departing executive director Irving Pinder, every incident or indiscretion by a licensee would be treated as major threat to the citizens of Maryland. Stories abound that physicians were denied; hearings, due process rights, meetings with the entire Board membership, the ability to present exculpatory evidence and other rights embedded in Maryland law. More egregious many of the physicians engaged to review their colleagues had less than stellar records themselves. Physicians who were forced into a hearing before an administrative judge found even when they won, the Board reversed the findings and sanction them. Indisputably, the present Board of Physicians has harmed many physicians’ careers and is not up to the challenge when a real medical threat comes their way. Two points should be mentioned here: 1) physicians who presented their cases pro se always lost even when the facts were 100% in their favor and 2) The Appellate Courts will rubberstamp any fabrication the Maryland Board of Physicians presents to them. The system is wired so that a physician must spend his lifesavings and more to defend his reputation and license in the event he/she wants justice to prevail in the case they are presenting to the Courts. Democracy is not democracy when there is no money to spread around. Please review the links, these articles enhance and expand on the information presented in this one. America's Christmas tree: A National disgrace

America’s Christmas tree: A National disgrace

America’s Christmas tree represents the collective conscious of a nation during this holiday period. Standing a short distance from the White House something other than a national symbol was erected to represent the spirit and sentiments of a nation during this time. A diminutive misshapen evergreen with diminished ornamentation was deliberately placed there to reflect the Federal government’s insensitivity to America’s religions, traditions and values. Surrounding this disgrace, are more than fifty smaller trees with a poverty of decorations, representing the states and various territories. Moving through the throngs of visitors to this site, many comments echoed through the air, some were less than dignified. Are Americans to believe this is the best tree that could be found to honor this season? Perhaps this is a subliminal message from our Commander-in-Chief de-emphasizing the meaning and intent of this national tradition. Many in the government are afflicted with a secular mentality favoring nihilism over conservative religious dogma. These individuals also have a convoluted belief that God died when Obama came into office.  America has been snubbed by its handlers in the form of a tree that embodies these derivatives and derides the importance of the majority’s customs and beliefs. Many interpretations can be extrapolated by this effrontery to America’s celebration. The Executive branch has shifted loyalties to those who are less than friendly to the USA. What better way to display these affections than in a denigration of a National symbol.  Perhaps this is the clarion call that finally awakens this slumbering giant into the recognition that those at the wheel do not know how to steer. Davis Amendment to Obamacare: Will Congress pass such legislation

Davis Amendment to Obamacare: Will Congress pass this legislation

Obama is running around the country, at the taxpayers’ expense, exalting the virtues of equitable taxation, especially on the so-called wealthy. Yet, this same man does not believe in the equitable distribution of health care as embodied in his own legislation, Obamacare. Historically, Obama has demonstrated his hypocrisy under many circumstances, over and over again. Granting waivers to thousands of companies, groups and friends of Obama to opt out of his irrational health plan, is tantamount to stating some people are more equal than others. Since Obama continues to echo the theme of fairness through many of his poorly written speeches, it leads me to believe he would sign the Davis Amendment to Obamacare. This Amendment, which has a simple format, states the following: From this day forward all waivers are cancelled and no further waivers will be granted for Obamacare. Every group in the country including but not limited to the Executive Branch, Civil Service employees, Federal Employees, Federally elected officials, Members of the Supreme Court, state government employees including state elected officials, all union officials and their constituent members representing any and every group within their domain, the Hollywood elite,  the entire population of these United States and our unwelcome guests and more will come under the scope of Obamacare without exception. To demonstrate that his speeches are not mere words to continue his fetid programs over another 4 years, Obama should immediately return to his Oval Office and put his pen to this Amendment. This means Obama and his family, Nancy Pelosi, Harry Reid, the Hierarchy of the AARP that supported Obamacare but was exempted from its many deficits and the rest of Obama’s courtiers will now have the same access or lack thereof to medical care. Time has come for Obama to stand by his words, not behind them and act like a president. Two things for certain; One, he will not sign this Amendment because he knows it will put his family at great risk, and secondly he would not be reelected. Obama has been able to game the system with an enormous transfer of wealth from the taxpayers to his deadwood following, hoping that a second term will be his to enjoy. He forgot one thing, the system he gamed is falling apart around  him, directly as a result of his influences and poor decisions. Vote right in 2012, there is nowhere else to turn. Maryland Court of Special Appeals: Who do the judges serve

Maryland Court of Special Appeals: who do the judges serve

Colonial America had a deep distrust for the legal profession and the arbiters they served. Most worked for the British monarchy interspersed with a few homegrown sentinels of democracy. Once the king was given his walking papers through the Declaration of Independence, a new set of laws were required to engineer the evolving country. In order to make the Constitution palatable to the new Americans, the word lawyers or references to them were omitted. This great document allowed a person to appear before a court without requiring the services of an attorney to state his/her case. Two hundred twenty five years later America is being suffocated by a legal industry that brings the country closer to ruin. Courts were designed to bring balance and resolve to problems brought before them. Today’s court decisions are driven by factors other than the questions that initiated the cases. A lesson this former physician learned when he received a decision from the Maryland Court of Special Appeals. In case number 2587, September Term 2009, Judges Krauser, Wright and Salmon sent me a decision that they knew was contrary to present law, but more profound it was deceitful. The details would take several pages of boring verbiage, the bottom line is the Court went out of its way to uphold false charges that the Maryland Board of Physicians levied against me six years prior. A recent audit by the Maryland State Legislature of the Maryland Board of Physicians found that this entity acted outside Maryland Law and Mandate when prosecuting cases against physicians. The Court had to know they were substantiating fabrications against me, yet they sold their souls to a rogue administrative entity, the Maryland Board of Physicians, so it would not lose the case. The facts are now out, Judge Bell in the Court of Appeals refused to hear a Writ of Certiorari, further confirming that the Courts will lie to uphold decisions from state agencies that are completely false. To answer the premise who do the judges work for: themselves. The shame is once these irreverent overpaid judges are in place, it is very difficult to relieve them of the mischief they cause. The question is how many more physicians have been quietly screwed by  these black robed thugs. If you know of any, please contact me. Mark Davis, MD

Donald Trump: Can he take the heat

Donald Trump: Can he take the heat

Growing up on the streets of New York City, a person solidifies a certain personality. New Yorkers are perceived as abrupt, confrontational, ill-mannered, egotistical and more. These traits may not work in the softer parts of the country but they are necessary tools if one is to live in the town that never sleeps. Donald Trump has merged many of these traits into a personality that allows him to be effectual in the functions he performs daily. No one survives for long amid the high-rises that defines Manhattan, without some semblance of a strong personality and the street smarts to accommodate it. Trump has taken heat for coaching candidates from the sidelines instead of sticking his neck out and joining the crew. His on again off against flirtation with the Executive Office has riled many, causing them to take one step back from his stance on the issues of the day. Donald Trump sees our culture imploding along with the economic disasters that are managed by the present occupant in the White House. Trump has many groupies but an equal number of detractors in his following. Accumulation of wealth may have been the driving force which brought him to the pinnacle of success that he has enjoyed for decades, but he has never lost sight of his origins. Now in his sixties, he is the emeritus billionaire who the politicians have come courting for support. Millions may shift their thinking once the Donald reveals his. This super magnate never backs down from controversy, just ask the slime who have tried to defame him over the years. Can Trump take the heat would be better stated, can his courtiers take the heat from him. Personally, I am glad he is stirring the political cauldron, who else has the flair and presence to make 2012 so interesting. God speed Mr. Trump, America could use someone like you behind the wheel. Stealing Democracy Obama Style

Stealing democracy Obama style

Obama’s greatest talent is deception. His birth records, recently released from their artificial cocoon, continue to create doubts to his origins. School records to validate Obama’s genius, as the media would like us to believe, have been sequestered along with the methodology he used to obtain admission to Harvard Law School. Two books credited to his name have the mark of an erudite ghostwriter, not from the hand of someone who requires a teleprompter to construct simple sentences. Obama was weaned on left wing rhetorical nonsense, why should we expect any better from him. For last three years Obama has successfully deconstructed institutions and traditions that have taken two centuries of sacrifice to establish. He has removed the words democratic and democracy from our fund of knowledge, replacing it with his brand of socialism. Obama’s sophistry is so profound that he even believes his own veiled lies. America exists at the right time to have such a chief executive.  This nation was deliberately dumb down in the last generation removing any analytic ability voters have to discern the danger zone candidates such as Obama would place this nation in. True reality hits hard when someone awakens from a coma. America, in the majority, is beginning to realize that they are not in Kansas anymore. From Main Street to Wall Street legal structure has changed, placing more control of our lives, in the hands of the central government at the expense of the individual. Obamacare is the president’s crowning achievement. This legislation was never intended to improve health care. It was a gift to lawyers, unions, Obama supporters and the indolent who will benefit by it in a myriad of ways. Wealth redistribution not health care will be the final outcome for a legislation that should never have seen the light of day. Obama’s intends to descend into Hell, the problem is he wants to take the rest of us with him. Do not let him, vote right in 2012. Maryland: America's entitlement capital

Maryland: America’s entitlement capital

Maryland is known for many things; dumb down schools, violent streets, over taxation, a business unfriendly environment, a penchant for left wing politics, high levels of discrimination, preferences in the work place, a misdirected Executive branch, a large population of illegals and many more negatives detrimental to its citizens. Most egregious of all is Maryland state government’s misuse of funds they extort from the private sector. Billions of dollars move from Annapolis to the lazy, indolent and undeserving. The biggest waste comes in the form of the Medical Assistance program. The Maryland’s Executive branch must be advertising in every nation on Earth, “come to Maryland and obtain free health care at the expense of its tax paying citizens.” And so the come from Asia, Europe, Africa, the Pacific Rim and most of all south of the border. By the tens of thousands they receive free medical care, free dental services including orthodontics, nursing home stays, hospitalizations, surgeries including cosmetic repairs and much more. These new imports are not in Maryland one week and somehow they find the entitlement offices as though they were given a map. Governor O’Malley calls them new immigrants/arrivals that must be helped. I call them freeloaders who are soaking us. The joke is on everyone who pays into the Maryland treasury. Daily thousands of letters emanate from the Maryland Comptroller’s Office threatening businesses and individuals to pay up or face certain catastrophe from them. Many of the so-called indigents drive high end cars, live in expensive homes and some have their children in private school. The working poor are those who support a state that has no vestige of decency left, inflicting higher taxes on us, to pay for these continued giveaway programs. The solution means test everyone in the state. It was worked in other jurisdictions and it can work here. Secondly, vote out the idiots who continue these irrational financial policies. Maryland Board of Physicians versus Mark Davis, MD

Maryland Board of Physicians versus Mark Davis MD

Lost among the myriad of news releases this week was the revelation that the Maryland Board of Physicians has been performing its functions in an illicit manner. Statutes designed to provide a level of fairness to physicians when their licenses come under review have not been implemented. A Maryland legislative audit, recently released, is noteworthy for the fact that mandates enacted in 2003 have not been adopted by this administrative entity. In other words, the Maryland Board of Physicians has gone rogue. This agency embedded within the Maryland Department of Health and Mental Hygiene has no day to day oversight. The Board’s lack of transparency has allowed it to move among the shadows hiding their illegitimate acts in reams of paper, unscrutinized but by a few insiders. Mark Davis, MD has had to bear the brunt of a fabricated action against him that should never have occurred. Nine years ago, the medical board on its own initiative, instituted an action against him concerning five medical records out of thousands from his practice. There were no complaints from anyone in the health industry levied against him or from any patients. Standards of care concocted by attorneys for the Board were the hammer via an action that was instituted against this physician.  Maryland Medical Board’s deviance is displayed by the following illicit actions they took to bring this case to fruition. First, two physician reviewers must be in agreement before charges can be brought against another physician. In the event they disagree a third doctor must be brought in to reconcile their disagreement. In 2003 this latter scenario was mandated by the Maryland State legislature. It’s the law of Maryland, which has been deliberately ignored by the Board of Physicians attorneys and staff. In the case of Mark Davis, MD this exact scenario played out, yet charges were drawn against him. More egregious, the two medical reviewers were both engaged from a private company that had been previously sued twice by Mark Davis, MD. In addition, both physician reviewers were well known to the  Mark Davis, MD from prior encounters. These horrific biases were completely disregarded by the Board’s staff. Even more horrific the attorney for the board, Robert Gilbert JD impeded Mark Davis, MD from presenting any defenses, including expert witnesses, in several judicial settings. In a similar fashion the Board refused to hear this case before its entire membership, yet they completely reversed the findings of their own administrative judge. Though the lower courts twice found in favor of Mark Davis, MD, Judges Krauser, Wright and Solomon of the Court of Special Appeals reversed these decisions allowing an illicit revocation of a medical license to go forward.  The Maryland Legislative audit displays clearly the board falsified its review, charges and court challenges against Mark Davis, MD. Much worse, Judges Krauser’s, Wright’s and Solomon’s opinion completely ignored the factual basis of this case, indicating that it was a fraudulent in nature. The Judges should be tossed off the bench. The lawyers for the medical board including but not limited Robert Gilbert and Noreen Rubin should lose their law licenses and more. Maryland Courts, especially its Appellate divisions, no longer protect the citizens they serve. Instead, they protect a bureaucracy that has lost any trace of decency that still exists in the vestiges of their small minds. Maryland's Medical Board: What went wrong

Maryland’s Medical Board: What went wrong

Maryland’s Board of Physicians has seen better days. Recent changes in its membership composition have turned it into little more than a neighborhood watch group. Its former expertise has evaporated, to make way for the present politically correct entity that has clearly and unapologetically flouted the very laws that empower them. Recently, the medical board has come under fire for its lax procedures, disregard for due process, failure to follow legislative mandates and sundry other issues uncovered by a legislative audit. Physicians no longer can look to the medical board for guidance in the course of their practices because this administrative entity has not promulgated any rules of procedure in the last decade. Though Maryland citizens have a right to competent medical personnel, this should not preclude physicians from obtaining unbiased, appropriate and legitimate review when their abilities are questioned. Maryland’s legislative audit was superficial, yet alarming. The physician community was aware of many of its findings for years.  Statutes written to provide a level of fairness to physicians during a review process have not been instituted. As a result a physician can now lose his/her medical license based on the word of one physician, who may not be in the specialty of the doctor under review contrary to Maryland law. This is exemplified in the case of Mark Davis, MD whose medical license is pending revocation. The medical board should have its charter revoked, and Dr. Davis’ case should be reviewed because of the illicit manner in which it was managed. Legislators are calling for an external review of the Board and plan to engage the services of a physician from the University of Maryland. This is a big mistake. The politically active doctor they have in mind will white-wash the mess the retiring director Irving Pinder is leaving behind. Maryland Board of Physicians needs to be reconstituted. All of its procedures should come under review and present actions against medical personnel should be put in abeyance until the public is allowed transparency into the board’s procedures and practices.
